As well as assisting with corporate insolvencies, Katie also assists with many personal insolvency situations which could include anything from pressure from HMRC, banks or credit institutions, to issues such as needing time to pay your creditors whilst a divorce is being finalised.

Our Corporate Procedures

Creditors’ Voluntary Liquidation (CVL)

A CVL is instigated by the directors of a Company to effect an orderly wind down, and may include the sale or transfer of the business and/or assets to a new trading entity.

Company Voluntary Arrangement (CVA)

A CVA is an arrangement between the Company and its creditors to repay them from future profit or a sale of assets. The Company makes a proposal to its creditors, and if the creditors agree to the proposal a licensed insolvency practitioner is appointed as "Supervisor of the Arrangement" to ensure that the terms are adhered to. This procedure can be particularly useful where the Company is under cash-flow pressure, but can see 'blue skies ahead'.

Members' Voluntary Liquidation (MVL)

An MVL is a procedure available to solvent companies. It is often used where clients are retiring, groups are restructuring, or when a company has come to the end of its useful life. When the assets accumulate to over £25k it can also be an effective method for tax planning.

Administrative Receivership

This option is normally available to all stakeholders who have a floating charge registered before 15 September 2003. It enables the stakeholders to appoint an Administrative Receiver to take control of the business, and realise the assets for the benefit of the charge holder

Fixed Charge/LPA Receivership

We can act on behalf of private or institutional lenders to maximise recoveries through the management and realisation of property investment portfolios. There are, in some circumstances, stamp duty tax advantages to appointing a receiver in these situations.

Compulsory Liquidation

A compulsory liquidation results from a winding up order being made from the court. Although the Official Receiver is initially appointed as Liquidator, we, or another insolvency practitioner, can be appointed in his place by the Court, the Secretary of State, or by creditors. Before making an application for a Compulsory Liquidation you should always seek independent advice, and we will be more than happy to meet with you for a free consultation.

Sole Traders and Individuals

Individual and Partnership Voluntary Arrangements (IVA’s and PVA’s)

We can act in relation to IVA’s in respect of individuals, or PVA’s in relation to partnerships. IVA’s can relate to sole traders or individuals who are not running a business. Voluntary Arrangements are a legally binding agreement between the individual or partnership to restructure, and repay, their debts, not necessarily in full and without the consequences of Bankruptcy. Voluntary Arrangements can be useful where cashflow is an issue and you wish to avoid formal bankruptcy, or where you are in a position to offer a full and final settlement to your creditors (e.g. by way of a contribution from a family member).


Bankruptcy results from a Bankruptcy Order being made by the Court. Although the Official Receiver is initially appointed as the ‘Trustee in Bankruptcy’, we or another Insolvency Practitioner may be appointed as Trustee by the Court, Secretary of State, or Creditors. Before applying for bankruptcy you should always seek independent advice, and we will be more than happy to have a free consultation with you to discuss the implications, including the risk to your home.
